These Terms of Service govern your use of BotMarket24.com and the BotMarket platform. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using BotMarket, you confirm that you are at least 18 years old, have the legal capacity to enter into contracts, and agree to these Terms. If you are using BotMarket on behalf of a company, you represent that you have authority to bind that company.

2. Account Registration

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. Listings and Seller Responsibilities

Sellers must provide accurate descriptions, including condition, specifications, and known defects. Listing prohibited items, misrepresenting products, or manipulating the platform is prohibited. Sellers are responsible for fulfilling sales and shipping items as described.

4. Buyer Responsibilities

Buyers must complete purchases they initiate. Payment is due at checkout. Buyers are responsible for verifying suitability of products for their intended use. Chargebacks or payment disputes initiated without contacting us first may result in account suspension.

5. Fees and Payments

BotMarket charges a volume-based platform fee on each transaction, deducted from seller payouts and charged to buyers at checkout. Seller fees start at 7.99% and decrease as cumulative volume grows, down to 2.99% for enterprise accounts. Buyer fees start at 4.99% and decrease similarly. Current fee tiers are displayed on the pricing page. Where BotPay is used, an additional BotPay fee of 1% per transaction applies (or a flat subscription of $299.99/month). We reserve the right to update fee rates with 30 days' notice. Subscription fees are billed in advance and non-refundable except as required by law.

6. Prohibited Conduct

You may not use BotMarket to conduct fraud, money laundering, or illegal activity; circumvent our fee structure; harass other users; scrape or copy the platform; or list items that are stolen, export-controlled without proper authorization, or otherwise illegal to sell.

6a. Off-Platform Transactions

Soliciting or completing transactions outside of the BotMarket platform is strictly prohibited. This includes — but is not limited to — sharing contact details (phone number, WhatsApp, Telegram, WeChat, email, or any other channel) with the intent to close a deal off-platform, instructing a buyer to cancel and repurchase through an external channel, accepting direct bank transfers or cash as payment for a BotMarket listing, and linking to external storefronts or personal websites as a workaround to avoid platform fees. Any attempt to circumvent the platform transaction system — regardless of the channel used — is grounds for immediate listing removal and permanent account termination. BotMarket monitors messaging and listing content for off-platform solicitation signals.

7. Intellectual Property

BotMarket owns or licenses all platform content including design, code, and editorial content. You retain ownership of content you submit (listings, photos) but grant BotMarket a worldwide license to display and promote it. Do not upload content you do not have rights to.

8. BotPay Buyer Protection

BotPay is BotMarket's optional buyer protection service. When enabled at checkout, funds are held by Stripe on behalf of BotMarket until the buyer confirms receipt or the auto-release window expires. Auto-release fires 30 days after confirmed delivery for BotPay users, or 90 days after delivery for transactions where BotPay was not activated. Manual-release mode allows the buyer to hold funds until they are satisfied the item matches the description. Buyers may freeze funds and open a dispute at any time during the hold window. BotPay does not guarantee item quality — it guarantees the payment process. BotMarket is not a party to the underlying sale.

9. Dispute Resolution

Transaction disputes between buyers and sellers should first be resolved directly. If unresolved, contact our support team. BotMarket may mediate but is not obligated to resolve private disputes. Decisions by BotMarket in disputes are final for platform purposes.

10. Limitation of Liability

BotMarket is a marketplace platform and is not a party to transactions between buyers and sellers. We are not liable for the quality, safety, or legality of listed items. Our total liability for any claim is limited to the fees you paid to BotMarket in the 12 months preceding the claim.

11. Disclaimers

BotMarket is provided 'as is' without warranties of any kind. We do not guarantee continuous availability, error-free operation, or that the platform will meet your requirements. Use of the platform is at your own risk.

12. Platform Content — BotEdu, Papers & BotGuides

BotMarket publishes AI-assisted editorial content including news articles, research paper summaries (BotEdu / Papers), and buying guides (BotGuides). This content is for informational purposes only and does not constitute professional, legal, financial, or technical advice. We do not guarantee the accuracy of AI-generated summaries. Research paper summaries link to original sources and do not re-host copyrighted material.

13. Changes to Terms

We may update these Terms at any time. Material changes will be notified by email or platform notice. Continued use after changes take effect constitutes acceptance. If you do not agree to revised Terms, you must stop using the platform. Contact us with any questions.

14. Governing Law

These Terms are governed by the laws of Poland and the European Union where applicable. Any disputes shall be subject to the jurisdiction of the courts in Katowice, Poland, unless consumer protection laws in your jurisdiction require otherwise.
